Retail pot shop coming By Staci McBrayer The Black Hawk City Council met in the Council Chambers for their regularly scheduled meeting on October 8th, 2014. Mayor David Spellman, Aldermen Jim Johnson, Paul Bennett, Linda Armbright, Greg Moates, Hal Midcap and Benito Torres along with City Attorney Corey Hoffman and City Manager Jack Lewis were present. Introduction of New City Employee City Clerk/Administrative Services Director Melissa Greiner introduced new Deputy City Clerk Michele Martin to the Aldermen. Martin, a Rollinsville resident, previously worked for the Town of Nederland in the capacity of Town Clerk. 2015 Operating Plan and Budget for the Black Hawk Business Improvement District The Council approved the Black Hawk Business Improvement District 2015 Operating Plan and Budget. The District anticipates $145,395 in property tax revenue in 2015 from the county assessed value of $203,633,970 on properties in the District. The mill levy is 0.714 mills. The District’s beginning fund balance for 2015 is estimated to be $265,803. Expenditures in the budget total $337,250. The largest expenditure for the District is marketing ($200,000). HARD District Rezoning Aldermen approved the rezoning of City owned property on Bobtail Street to the History Appreciation Recreation Destination District (HARD District.) The land was previously zoned Mixed Use (HD.) The properties, lots 1, 2, and 3 of block 34, were purchased in June of this year. The parcels are bisected by the right-of-way for Bobtail Street and are located south of the former Winner’s Haven Casino. The intent of the rezoning is to preserve the land’s historical and cultural values as public use, City-owned land. Hillside Street ECP District Rezoning and Minor Subdivision The Council also approved the rezoning of blocks 1, 2, and 3 on Hillside Street to the Environmental Character Preservation District (ECP.) The City-owned 3.18 acres is located along the platted Hillside Street right-of-way and Horn Street. Though there is platted right-of-way to the lots, there is no constructed street (though some of the lots do have access from Horn Street.) No structures currently exist on the lots. The property was originally zoned Historic Residential (HR.) HR zoning is designed for single family uses, however, the terrain and access of the three blocks do not allow for development pertaining to this use. The purpose of the ECP zoning is “to preserve environmentally and culturally sensitive areas that are prominent features of the community, and protect public health and safety.” Aldermen also approved a minor subdivision of the land, thus removing the internal lot lines of each block. Retail Pot Shop at 231 Gregory Street - Sign Plan City Council approved a Standard Sign Plan and License Agreement for 5B1S, LLC. The company plans to do business as 1859 Est. Retail Marijuana Shop located at 231 Gregory Street. The retail shop is permitted 128 square feet of sign area as per the Municipal Code. 5B1S, LLC proposed 26 square feet of sign. A condition of the sign plan approval is that storeowners Culver Van Der Jagt and Frank Garofalo obtain a license agreement with the City for two proposed blade signs that will project into the City owned right-of-way along Gregory Street. Chlorine Dioxide Generator Purchase Agreement Aldermen approved the purchase and installation of a Model GS-8 Gas Solid chlorine dioxide generation system for the Hidden Valley Water Treatment Plant. CDG Environmental submitted the only bid for the project in the amount of $48,780. The decision came about due to concerns on the City Staff’s part to keep the City’s water quality high. The Hidden Valley Water Treatment Plant uses raw water from Clear Creek. Clear Creek has high total organic carbon (TOC) contaminants in it during spring runoff. TOC reacts with chlorine creating disinfection byproducts (DBP.) DBPs have potential negative health effects. The Hidden Valley Water Treatment Plant is near its maximum contaminant level set by the Colorado Department of Public Health and the Environmental Protection Agency. Through a bench scale test performed on the incoming water, it was determined that a significant reduction in the DBPs could be achieved through the use of chlorine dioxide. City Lease with Allensworth Concepts, LLC A lease agreement with Allensworth Concepts, LLC for 135 Clear Creek Street was approved by the City Council. Allensworth Concepts, LLC operate the Mountain Mocha Café at that location. The terms of the three-year lease include $950 per month rent to be adjusted yearly for inflation and a $500 damage deposit. Allensworth Concepts will also receive a monthly rent credit equal to the average monthly sales tax collected for the previous twelve months period ending August 31 st . The credit will total $622 per month. Additionally, Allensworth Concepts has a sales tax credit of $3,424 to be applied to future lease payments. The sales taxes were submitted from April 1, 2014 to August 31, 2014. Appeal Denial Resolutions Aldermen finalized their actions made at the previous meeting to deny the appeal of the decision made by the Community Planning and Development Administrator regarding both 151 Marchant Street and 321 High Street. Property owners of both locations sought grants with site work components to construct a soil stabilization wall at both locations. At a hearing held on September 24 th , the Council upheld the Staff’s decision to deny the site work component grant. Council members solidified this decision in two different resolutions stating as such. City Manager’s Report: 2015 Proposed Budget City Manager Jack Lewis notified the Council that he had planned on having hard copies of the City’s 2015 budget available for the Aldermen’s review at the meeting, however, “production glitches” prevented the availability of the copies. Lewis stated that in order to meet statutory requirements to have the preliminary budget available to the Aldermen by October 15 th , he would have an electronic copy available by October 10 th .
