Black Hawk ensures water resources

Council congratulates Public Works, Fire, and Police teams on excellent handling of snow and associated emergencies By Randy Beaudette Black Hawk City Council gathered for a Special online meeting on Wednesday, March 17, 2021. Highlights of that meeting include a water lease agreement between Black Hawk and Clear Creek County, a resolution to change selected addresses along Gregory Street, and a residential exterior paint program guide. Mayor Spellman called the Council to order promptly at 3:00 pm followed by Roll Call and an online Pledge of Allegiance. Roll call revealed Council members that were present online included Aldermen Linda Armbright, Paul Bennett, Jim Johnson, Hal Midcap, Greg Moates, and Benito Torres. Also present online were City Attorney Corey Hoffmann, City Manager Stephen Cole, City Clerk/Administrative Services Director Melissa Greiner, and Deputy City Clerk Michele Martin. City Attorney Hoffmann asked Council to declare any Conflicts of Interest on any issue appearing on the agenda that afternoon other that than those already disclosed and filed with the City Clerk and Secretary of State. There were no objections from the City Council or from anyone online. Executive Session Black Hawk City Council motioned to adjourn into Executive Session at 3:03 pm to receive legal advice on specific legal questions, pursuant to C.R.S. 24-6-402(4)(b), and to determine positions relative to matters that may be subject to negotiations, develop a strategy for negotiations, and/or instruct negotiators, pursuant to C.R.S. 24-6-402(4)(e). Council returned back into Public Session at 3:37 pm. Meeting Minutes Black Hawk City Council approved the meeting minutes from the February 24, 2021 Regular Meeting with no corrections or amendments. Public Works Appreciation Mayor Spellman wanted to take a moment to compliment and congratulate the Public Works Department on how they handled the recent snowstorm; they did a great job. Alderman Bennett added that the Fire Department and Police Department were also out there helping out and clearing out resident’s driveways. There was a round of applause in thanks to all those departments. Black Hawk Clear Creek County Water Lease Agreement (Ordinance 2021-6/ Council Bill 6) The City has an opportunity to lease water to Clear Creek County. Clear Creek County may have a shortfall of water with the low snowpack and may need additional supplies to meet their demand. The water leased to Clear Creek County would be supplied from water the City has stored in Guanella Reservoir through an agreement with the City of Golden. The Storage Agreement with Golden requires that any water remaining in the Reservoir at the end of each year is booked over to Golden. Instead of giving the water to Golden, the City would lease the water to Clear Creek County, who would use the water to help meet their demand. The one-year lease 5 of 199 4 is for up to 30-acre feet of water at $2,500 per acre-foot. Clear Creek County would use the leased water for one of their constituents to fill a small lake. Clear Creek County and the City jointly own Green Lake and have been good partners in sharing their water resources. Black Hawk Park Plat (Resolution 8-2021) The City of Black Hawk has received an application from Dalton Horan of Ventana Capital, Inc and Jason Krall of Rick Engineering on behalf of the property owner Club Vista Properties II, LLC requesting review and approval of a Preliminary Plat and a Final Plat for the Black Hawk Park subdivision. The applicants request the subdivision of Lot 1 Block 1 Miners Mesa Subdivision Filing No. 4 into nine (9) commercial lots and one (1) tract for the purpose of developing the property with an Airstream RV Campground, a distillery and other commercial uses. As a reminder, the City Council opened and closed the public hearing on February 10 and did not make a decision to approve or deny, but continued the decision to this March 17, 2021 agenda. The reason for no decision was that a Subdivision and Development Agreement was not yet signed on that date. One sticky point in the Subdivision Agreement, according to City Attorney Hoffmann, is that the infrastructure to support such subdivision must be paid by one or more parties involved in the Agreement. As of yet the infrastructure agreement has not been signed. According to City code, the Infrastructure Agreement needs to be resolved before the Subdivision Agreement can be approved. For that reason, Black Hawk City Council unanimously approved a continuance of Resolution 8-2021. First Addendum to Professional Services Agreement with SAFEbuilt LLC (Resolution 10-2021) Black Hawk City Council approved the First Addendum to Professional Services Agreement with SAFEbuilt LLC as introduced by Community Planning and Development Director Linker. It was stated that this is an addendum to the Professional Services Agreement approved in January of 2021. This addendum is required because they are changing their Fee Schedule to add a City rate and Land Use Review rate. Address Changes (Resolution 11-2021) City staff recently discovered the existence of duplicate addresses within the City of Black Hawk and Central City located within the 300 block of Gregory Street. Within the City of Black Hawk, this includes the Gregory Street Plaza currently under construction. Prior to the establishment of retail businesses within the Plaza, City emergency personnel have requested the duplicate addresses be changed in order to avoid confusion for dispatch, emergency responders, and the general public. Black Hawk City Council approved Resolution 11-2021 unanimously. Water Storage Documents (Resolution 12-2021) Over the past eight years, the city of Black Hawk attained an additional 60.1 acre feet of storage in Georgetown Lake as a result of various InterGovernmental Agreements with Georgetown. The current storage decree (2007CW327) is for 100 acre feet of storage in the lake. In order to make use of the City’s full amount (160.1 acre feet), the City is required to file a Water Court Application for the additional storage amount. Black Hawk City Council approved Resolution 12-2021 unanimously. Residential Exterior Paint Program Guide (Resolution 13-2021) The City requires a paint contractor specializing in comprehensive painting services that provide all supervision, labor, equipment, tools, supplies, and material for residential and municipal projects on an “on-call” basis. On January 8, 2020, City Council approved by Resolution 2-2020 a Professional Services Agreement between the City of Black Hawk and Gonzales Custom Painting, Inc. City Council recently renewed said Agreement on January 13, 2021, by Resolution 4-2021. The Residential Exterior Paint Program Guide to Programs was original adopted by City Council by Resolution 56-2014 on August 27, 2014. With the approval of the 2021 annual budget and the renewal of the Professional Services Agreement, the Residential Exterior Paint Program – Guide to Programs and Exhibits required an amendment. Black Hawk City Council approved Resolution 13-2021 unanimously. Next Meeting The next Black Hawk City Council regular virtual meeting will be held March 24, 2021 at 3:00 pm.
