Black Hawk gets annexation support from Gilpin County

Gregory Street Plaza Project moving along with rock slope stability mitigation By Randy Beaudette An amendment to the contract between Black Hawk and Roche Construction was the only agenda action item discussed during the Black Hawk City Council meeting held on March 11, 2020. Black Hawk Fire Lieutenant Chris Reid rang the bell promptly at 3 pm to announce the start of the regular meeting. Mayor Spellman called the Council to order followed by Roll Call, then led in the Pledge of Allegiance. Council members that were present were Linda Armbright, Paul Bennett, Jim Johnson, Greg Moates, and Benito Torres. Alderman Hal Midcap was absent. Also present were City Attorney Corey Hoffmann, City Manager Stephen Cole, Police Chief Kenneth Lloyd, City Clerk/ Administrative Services Director Melissa Greiner, Public Works Director Tom Isbester, Finance Director Lance Hillis, Planning and Development Director Cindy Linker, and Deputy City Clerk Michele Martin City Attorney Hoffmann asked Council to declare any Conflicts of Interest on any issue appearing on the agenda other that than those already disclosed and filed with the City Clerk and Secretary of State. There were no objections from the City Council or from the attendees in the chambers. Approval of Minutes Black Hawk Aldermen approved the meeting minutes from the February 26, 2020 Regular Meeting with no changes or amendments. Contractual Amendment (Resolution 22-2020) Black Hawk City Council approved Resolution 22-2020 which is a Resolution approving Amendment No. 5 to the Construction Manager/ General Contractor Agreement for the Gregory Street Plaza project. Amendment No. 5 would increase the Guaranteed Maximum Price (GMP) for the purpose of installing rock slope stabilization measures along the north side of the Gregory Street Plaza. The Construction Manager/ General Contractor (CMGC) contract with Roche Constructors, Inc. was approved on February 27, 2019 to complete preconstruction services for the Gregory Street Plaza project. City Council approved Amendment No. 1 to this Agreement on July 10, 2019 that authorized Roche Constructors to move the McAfee, Woodbury, and Norton Houses off their foundations and procure the precast sections of concrete box culvert necessary to reconstruct the flume between High and Church Streets. On September 25, 2019, City Council approved Amendment No. 2 that authorized building and site construction throughout the Gregory Street Plaza. On December 11, 2019, City Council approved Amendment No. 3, authorizing exterior rehabilitation of the historic church located at 331 Gregory Street. City Council approved Amendment No. 4 on January 22, 2020 for procurement and installation of an elevator at 221 Gregory Street. The area behind the McAfee, Woodbury, and Norton Houses has recently been excavated, exposing a steep rock face. A rock slope stability evaluation report prepared by Terracon Consultants, Inc., dated February 7, 2020, recommended installation of about 80 rock bolts of various sizes at specific locations throughout this rock face. Additionally, all existing wire mesh will be removed, and new narrow-gauge wire mesh would be installed on the entirety of this rock slope. Amendment No. 5 to the original CMGC Agreement would authorize installation of these stabilization measures. The GMP increase due to the additional scope included in Amendment No. 5 is $297,700, which would bring the overall project GMP to $13,536,052. City Manager’s Report Black Hawk City Manager Stephen Cole announced that he and his and his staff have been working on a strategic plan to address the Coronavirus or COVID-19. From the City’s website, “The City of Black Hawk is working closely with the Jefferson County Public Health to keep up to date on the developments and preventative guidelines. JCPH updated its site on Monday and Thursday to relay accurate information.” City Attorney’s Report City Attorney Corey Hoffmann suggested a motion for an Executive Session. Before breaking for Executive Session, Mayor Spellman wanted to mention that at the last meeting he announced that he had invited Commissioner Ron Engels to the Public Hearing on March 25 to see if the County Commissioners would speak in support of the annexation in the Lake Gulch area. He is pleased to announce that Commissioner Engels did get back to him and stated that he did talk to his two fellow Commissioners and they certainly thought it was appropriate that he come to the meeting on March 25 to speak in support of the annexation in the Lake Gulch area. Mayor Spellman said this was good news that the Commissioners are looking out for the best interest of the County and what this project would mean to the County as far as the additional revenue. This is a good, positive, and responsible decision by the Gilpin County Commissioners. Mayor Spellman said he then talked to Commissioner Engels, who also sits on the Board of Directors for the Central City Opera House Association, and asked him if he would like to get approval to speak on behalf of the Central City Opera House Association, or if someone else could attend from the Association to also speak in support of the project. He believes there is a relationship that could be built between Proximo Spirits and the Central City Opera House Association in the future. Commissioner Engels said he would ask and get back to him, but in the meantime, he has confirmed that the Commissioners are in support of the annexation, and he plans to attend the Public Hearing on March 25 to state their support. Mayor Spellman thought it was important to have that in the record. Executive Session A motion was accepted to recess into Executive Session to determine positions relative to matters that may be subject to negotiations; developing strategy for negotiations; and instructing negotiators. Black Hawk City Council recessed into Executive Session at 3:08 pm. Next Meeting The next Black Hawk City Council regular meeting is planned for March 25, 2020 at 3 pm at 211 Church Street, Black Hawk, Colorado.
