Black Hawk proceeds with Hidden Treasure Trailhead

Council creates new BHPD Corporal position By Randy Beaudette Acting Black Hawk City Manager Stephen Cole rang the bell promptly at 3:00 p.m. to signify the start of the Black Hawk City Council meeting, January 9, 2019. Mayor Spellman called the Black Hawk City Council to order followed by Roll Call, then led in the Pledge of Allegiance. Council members that were present Aldermen: Linda Armbright, Paul Bennett, Jim Johnson, Hal Midcap, and Benito Torres. Alderman Greg Moates was absent. Also present were City Attorney Corey Hoffmann, Acting City Manager Stephen Cole, Acting Police Chief Tory Jantz, City Clerk/ Administrative Services Director Melissa Greiner, Finance Director Lance Hillis, Public Works Director Tom Isbester, Planning and Development Administrator Cindy Linker, and Deputy City Clerk Michele Martin City Attorney Hoffmann asked Council to declare any Conflicts of Interest on any issue appearing on the agenda that afternoon other that than those already disclosed and filed with the City Clerk and Secretary of State. There were no objections from the City Council or from the onlookers in the chambers. Approval of Minutes Black Hawk City Council approved the minutes from the December 12, 2018 regular City Council meeting with no corrections. Retail Sales Amendment Finance Director Lance Hillis presented Ordinance 2019-01 which is an Ordinance Amending Section 4-41 of the Black Hawk Municipal Code Regarding Out-of-State Retailers doing Business in Colorado. In June 2018 the U.S. Supreme Court issued a decision in the South Dakota vs. Wayfair, Inc. case regarding the licensing and sales tax collection requirements of out-of-state retailers. The case was decided in favor of South Dakota thus removing the requirement that a retailer have a physical presence within a taxing jurisdiction in order to be required to collect and remit sales tax. The State of Colorado recently revised its requirements to be consistent with this ruling and this Ordinance will allow the City of Black Hawk to follow the rules promulgated by the State. There were no arguments for or against the Ordinance, so Black Hawk City Council approved Ordinance 2019-01 unanimously Meeting Notices (Resolution 1-2019) Black Hawk City Council approved Resolution 1-2019 Establishing a designated public place for the posting of Meeting Notices as required by the Colorado Open Meeting Law. City Clerk/ Administrative Services Director Melissa Greiner presented the resolution stating that the two new identical boards will be located in the plaza on Gregory Street. The boards will be mounted on a pedestal of a similar design to the light pole standard that the city has adopted. Fee Schedule Amendment (Resolution 2-2019) Black Hawk City Council also approved a Resolution amending the 2018 City of Black Hawk Fee Schedule. The changes include: Inspections Outside of Normal Business hours will be $200 an hour with a 4 hour minimum plus a 15% administrative fee; Primary Sign Application/ Plan Review fee will drop from $100 to $50; Commercial-Preliminary Land Use Application/ Plan review will drop from $200 to $50; and Temporary Use or Temporary Structure Permits will drop from $100 to $50. Hidden Treasure Trailhead Design Change (Resolution 3-2019) Public Works Director Tom Isbester presented a Resolution awarding a supplemental change order to the professional services agreement and authorizing the Mayor to execute the same for the Hidden Treasure Trailhead Final Design. This project has evolved since its original scope was defined. The parking lot size was modified to eliminate the need for turning lanes and CDOT access permit acquisition was started. There were some delays with the CDOT historic resources clearance at the same time the project was essentially shelved due to funding and time constraints. Additional landscaping elements were included just prior to stopping work on the design. This project is being resurrected and this change order will take the project through final design, contract documents, and bidding. Work will also include the CDOT access permit and associated historical clearances required for the permit. Construction assistance will be included with the construction contract award. The Project work will include a bridge over Highway 119 from the parking lot, the parking lot itself with the relocated Hawk statue, vault toilet, and parking lot lighting. Black Hawk City Council approved Resolution 3-2019 unanimously. New Corporal position in the BHPD (Resolution 4-2019) Acting Police Chief Tory Jantz introduced a Resolution that, if approved, would establish the position of Corporal in the Police Department along with Job Description for the same. During the 2019 budget process, the Police Chief received approval to develop a new program designed to prepare police officers for more supervisory responsibility. The Chief received approval to allow three (3) officers to serve as temporary Corporals with limited supervisory duties to help develop their supervisory skills. Officers would apply for the Corporal positions and if selected would serve for a period of one (1) year. They would receive a stipend of $400 a month for the year and would work closely with a Sergeant and a Commander. At the end of a year, they would re-apply for an additional year or return to their previously held position allowing someone else the opportunity to develop their supervisory skills. The program would last two years and would be evaluated to determine if it would continue, be discontinued, or be modified. The goal of the program is to develop future supervisors by reducing the risk associated with a formal promotion. Employees who want to become supervisors have an opportunity to “test drive” the position, thereby reducing their risk of failure in the future. It also gives the Police Chief the ability to evaluate prospective supervisors before they are formally promoted. The approval of the Corporal Job Description is part of an overall strategy to improve the capabilities of the Black Hawk Police Department staff. Black Hawk City Council approved Resolution 4-2019 unanimously City Manager’s Report Acting City Manager Stephen Cole informed the Aldermen that the City of Black Hawk has been invited to co-host a tour of Black Hawk and Central City as part of a National Trust conference to be held in October with an emphasis on how gaming dollars have impacted historical renovations. The first step is to submit an application with a plan to the National Trust and they will review and approve Black Hawk’s participation. Initially the plan is to host a tour and a luncheon for the group. Also, Christmas lights will begin to come down on January 27 th and City Manager Cole asked the City Council for input on next year’s display. With the addition of the St. Charles Carriage House and the buildings along Gregory Street, the City may have to purchase additional lights. If not in this budget year, then for certain the lights need to be added to the 2020 budget. City Council expressed their approval of this year’s display and suggested some minor additions. Thanks goes out to Black Hawk Public Works for a fun and festive display. City Attorney’s Report Black Hawk City Attorney Corey Hoffmann had nothing to report except the usual recommendation for Council to go into Executive Session regarding specific legal questions on potential upcoming legislation. Executive Session Alderman Bennett made a motion to go into Executive Session to consider the purchase, acquisition lease, transfer, or sale of real, personal, or other property per CRS 24-6-402(4)(a). To hold conference with the City Attorney to seek legal advice on specific legal questions pursuant to CRS 24-6-402(4)(b). To determining positions relative to matters that may be subject to negotiations; developing strategy for negotiations; and instructing negotiators pursuant to CRS 24-6-402(4)(e). The motion carried and Black Hawk City Council recessed into Executive Session at 3:10 p.m. Next Meeting The next Black Hawk City Council meeting will be January 23, 2019 at 3:00 p.m. located at 211 Church Street, Black Hawk, Colorado.
