Black Hawk Council cancels election

Municipal Court Judges reappointed By Randy Beaudette Mark Huff from JIJE Consulting rang the bell promptly at 3:00 pm to signal the start of the Black Hawk City Council meeting for February 14, 2018. Mayor Spellman called the Black Hawk City Council to order followed by Roll Call, then led in the Pledge of Allegiance. Council members that were present Aldermen: Linda Armbright, Paul Bennett, Jim Johnson, Hal Midcap, Greg Moates, and Benito Torres. Also present were City Attorney Cory Hoffmann, City Manager Jack Lewis, Police Chief Cole, City Clerk/ Administrative Services Director Melissa Greiner, Finance Director Lance Hillis, Community Planning & Development Administrator Cindy Linker, Public Works Director Tom Isbester, Fire Chief Taylor, and Deputy City Clerk, Michele Martin City Attorney Hoffmann asked Council to declare any Conflicts of Interest on any issue appearing on the agenda this afternoon other than those previous disclosures and conflicts that have already been disclosed and are on file with the City Clerk and Secretary of State. There were no conflicts noted from City Council. City Attorney Hoffmann then asked the audience if there were any objections to any member of Council voting on any issue on the agenda this afternoon. The audience had no objections. Standardized Tax Definitions (Council Bill 1/Ordinance 2018-1) During the 2014 session the Colorado General Assembly spent a considerable amount of time attempting to fashion a referred constitutional amendment that would have required all locally collecting home rule municipalities to use standardized definitions developed and maintained by a special State board. After being stymied by a variety of issues, the General Assembly instead asked CML to develop a package of standardized definitions. This ordinance is the result of a collaborative effort of home rule municipalities, attorneys and the business community. Additionally, the updated definitions simply reflect current tax practices, no new tax is levied and no increase in tax revenue is expected. Black Hawk City Council approved Ordinance 2018-1 unanimously. Reappointment of Black Hawk Municipal Court Judges Black Hawk City Council also approved two resolutions (14-2018 and 15-2018) which will reappoint Black Hawk Municipal Court Judges Ronald W. Carlson and Thad Renaud. The Municipal Court Judge position is a two year term, both Judgeships will expire on February 28. Judge Carlson and Judge Renaud were both last reappointed on February 24, 2016. Election Cancellation Resolution 16-2018 cancelled the April 3, 2018 election of City Council members declaring candidates of the open seats elected was approved by Black Hawk City Council. Aldermen Linda Armbright, Jim Johnson, and Haller Midcap were the only individuals that filed for the four year term positions thus they were declared elected due to lack of opposition. Site Improvement Agreement (Resolution 17-2018) A Resolution approving the Second Amendment to the Subdivision/ Site Improvement Agreement with JIJE, LLC for the Canyon Black Hawk Subdivision, Filing No. 1. This action includes the modification/ correction of condition H of the conditionally approved SIA that was approved on January 24, 2018. Condition H was related to the necessary North Clear Creek channel improvements required to ensure the Canyon site was outside of the 100 year floodplain. In addition this second amendment modifies/ clarifies the date by which all public improvements related to this project must be completed to be February 15, 2019. Resolution 17-2018 was approved by Black Hawk City Council. Black Hawk City Council adjourned to Executive Session at 3:07 pm. Next Meeting The next Black Hawk City Council will be February 21, at 3:00 pm at 211 Church Street, Black Hawk, Colorado.
