Black Hawk Council Meeting By Randy Beaudette Black Hawk City Council meeting on October 24, 2018 was called to order promptly at 3:00 p.m. by Mayor David Spellman followed by Roll Call, then led in the Pledge of Allegiance. Council members that were present Aldermen: Linda Armbright, Paul Bennett, Jim Johnson, Hal Midcap, Greg Moates, and Benito Torres. Alderman Jim Johnson was absent. Also present were City Attorney Corey Hoffmann, City Manager Jack Lewis, Police Chief Stephen Cole, Fire Chief Christopher Woolley, City Clerk/Administrative Services Director Melissa Greiner, Finance Director Lance Hillis, Community Planning and Development Administrator Cindy Linker, Deputy City Clerk, Michele Martin City Attorney Hoffmann asked Council to declare any Conflicts of Interest on any issue appearing on the agenda this afternoon other that than those already disclosed and filed with the City Clerk and Secretary of State. There were no objections from the City Council or from the folks in the audience. Approval of Minutes Black Hawk City Council approved the meeting minutes from September 12, 2018 regular meeting with no changes or corrections. PUBLIC HEARINGS Demolition Certificate of Appropriateness The applicant, City of Black Hawk, is requesting a Certificate of Appropriateness for demolition of the residential structure and attached garage at 531 Chase Street. This parcel is zoned Environmental Character Preservation (ECP) which allows single family homes and a Bed & Breakfast as an accessory use. The estimated date of construction for the original portion of this structure is ca. 1890, as recorded with the Gilpin County Assessor. The Assessor also indicates an effective year built of 1961, suggesting that significant modifications may have occurred to the building in or about that year. Due to additions and alterations, structure no longer contributes to the district.” January 25, 2009: While operating as a Bed and Breakfast, a fire significantly damaged this structure. May 13, 2009: City Council approved a Certificate of Appropriateness to allow demolition of the fire damaged portion of the structure. The Owner of Record never performed the demolition. July 22, 2009: City Council approved a Certificate of Appropriateness for reconstruction work of the structure. The Owner of Record never performed the reconstruction work to make the structure safe. The structure currently is in a damaged condition. July 6, 2017: The City of Black Hawk purchases the property and is now the Owner of Record. Due to the fact that the previous Owners of Record failed to complete the demolition and rehabilitative construction to make the structure safe, the City views the structure as a public safety hazard due to vandalism and being open to the weather. The City has determined that a portion of the structure is located in the Chase Street public right-of-way. This is a significant issue if redevelopment of the property were to be considered. Business Improvement District (BID) inclusion (CB 23/Ordinance 2018-23) Black Hawk City Council approved Council Bill 23, which is an Ordinance Approving the Inclusion of Property into the Black Hawk Business Improvement District and Changing the Boundaries of the District. The City of Black Hawk received a petition from JIJE, LLC (the “Petition”) for inclusion of property more particularly described as follows: Parcels: Canyon Black Hawk Subdivision Filing No. 1. A parcel of land being a portion of Blocks 36, 37, 38, 46 & 47, Main, Backus, & Bobtail Streets as described in City Resolution No. 69-2017 all in the City of Black Hawk, County of Gilpin, State of Colorado. Business Improvement District (BID) inclusion (CB 124/Ordinance 2018-24) Black Hawk City Council also approved Council Bill 23, which is an Ordinance Approving the Inclusion of Property into the Black Hawk Business Improvement District and Changing the Boundaries of the District. Black Hawk Employees Sick Leave Benefits (CB25/Ordinance 2018-25) Black Hawk City Council approved Council Bill 25, is an Ordinance Amending Section 306, Sick Leave Benefits, of the Black Hawk Employee Handbook Dated September 2018. The changes are as follows: If an employee is absent for five (5) or more consecutive work days due to illness or injury, a physician’s statement shall be required, verifying the absence and its beginning and expected ending dates. Such verification may be requested for other sick leave absences as well and may be required as a condition to receiving sick leave benefits. The former policy stated three (3) or more consecutive days… For more information refer to: https://www.cityofblackhawk.org/files/5915/3998/4730/2018.10.24_Packet.pdf City Attorney Report Black Hawk City Attorney Corey Hoffmann reported that this past week staff met with the law firm that the City has retained regarding the opioid litigation. This is the first step in the process that will eventually tell the Black Hawk’s story in a way that will ultimately be a complaint filed against pharmaceutical manufacturers and distributors. That process is ongoing and information will be passed on as it is available. Hoffmann also recommended that Council recess into Executive Session regarding specific legal questions relating to potential legislation and a potential claim against the city. Motion carried and Black Hawk City Council recessed to executive session at 3:18 p.m. Next Meeting The next Black Hawk City Council meeting will be November 14, 2018 at 3:00 p.m. at 211 Church Street, Black Hawk, Colorado.
