Gilpin emergency evacuation routes protected

Commissioners Approve Supplemental Appropriations By Randy Beaudette Gilpin County Commissioners Chair Ron Engels, along with Commissioners Gail Watson and Linda Isenhart, faced a short agenda for the regular Commissioners meeting that occurred on Tuesday November 20, 2018 at the Gilpin County Courthouse. To assist with the tasks at hand were County Attorney Brad Benning, County Manager Abel Montoya, and sitting in for the vacationing Deputy Clerk, Vicki Nemec. Gilpin County Finance Director Clorinda Smith presented three items to the Board of Commissioners all of which were Approved unanimously. Supplemental Appropriations First presentation was Resolution #18-24, Supplemental Appropriations to the 2018 Budget. This Resolution is to supplement the 2018 budget to prevent funds from going over budget. Supplemented funds in the sum of $456,200 listed as additional expenditures to the General Fund for grant expenses, benefits, fire mitigation, professional services, jail repair and maintenance, and capital outlays: $28,580 from grant revenue, $33,550 from insurance proceeds and $394,069 from the fund balance. $5,525 is supplemented as additional expenses to the Library Fund for grant expenses operating and programming; $2,225 from grant revenue plus $3,300 from contributions. $1,300 supplemented as additional expenses to the Public Health Fund for grant expenses utility and treasurer’s fees; $700 from grant revenue, $600 from the fund balance. $15,000 is supplemented as additional expenses to the Solid Waste Fund for benefits, fuel, repairs and maintenance from the fund balance. Grand total for this resolution is $478,025 in expenditures minus $64,356 in grant revenue to equal $409,669. Cost Allocation Plan Next Ms. Smith presented the 2019 Cost Allocation Plan Agreement between the County of Gilpin and MGT of America Consulting, LLC. A cost allocation plan is necessary in order to receive funds from the State of Colorado for Finance, Human Resources, Information Technology (IT), County Manager, and facility items. Total cost for this agreement will be $4,230 which is included in the 2019 budget. Audit Services Third and final financial related item was to approve an agreement between the County of Gilpin and Hinkle & Company P.C. for audit services for the year ending December 31, 2018. Services delivered by Hinkle & Company will include an audit of financial statements of the governmental activities; they will audit each major fund and the aggregate remaining fund information. Total cost of these services will be $17,000 if a single audit is required, additional fees will not exceed $3,000. 2019 Liquor Testing Events Gilpin County Local Liquor Licensing Board approved a permit for Mid-County Liquors to hold liquor tasting events throughout 2019. Mid-County Liquors will host two liquor tasting events each month featuring a variety of malt, vinous, or spirituous liquors. Emergency Evacuation Routes Gilpin County Commissioners conducted the second reading and approved Ordinance #18-01 which addresses the regulation of Emergency Evacuation Routes Over Private Property. Gilpin County has identified emergency and evacuation routes in specific subdivisions and developments that are crucial to Gilpin County’s Emergency Plan. Some of these routes are located on private property in which property owners volunteered to assist by allowing emergency evacuation routes to run through their property. Recently some of these routes have been utilized by people other than the property owner or emergency personnel. This ordinance will make it crime to use this route by anyone other than the property owner, emergency personnel or anyone evacuating an area in an emergency or disaster situation as declared by the Gilpin County Sheriff’s Office. Anyone who violates this ordinance may be charged with a Class 2 Petty Offence, and if convicted is subject to fines up to $1,000. In addition Trespassing charges may be also be added on top of the original violation to add up to some pretty hefty fines. Evacuation Route Property owners have reported people trespassing on their property to the Gilpin County Sheriff’s office. This has been a concern of some property owners who are hesitant to open up their property to an evacuation route, in that the route might be used for recreational purposes. This Ordinance will settle those concerns. Legal Status Report Gilpin County Attorney Brad Benning reported that Dirk Larsen, owner of the ongoing Larsen property code violations, filed a motion seeking clemency and asked for the case to be dropped, but there are some pending matters in that a majority of the violations have not been addressed or cleaned up. Gilpin County will file a motion to respond to Mr. Larsen motions this week and will continue seeking fines and penalties associated with those pending violations. The other item Mr. Benning reported on is that the owner of the Red Tail XP property in the Russell Gulch area contacted the County Attorneys Office and claimed that none of the code violations are on his property. There is some confusion concerning the ownership of the mining claims in that area. Bureau of Land Management (BLM) also has some property in the area in which these code violations have occurred. The County Attorney’s office will continue to pursue this matter to determine who owns what property and what and if any code violations remain. County Manager’s Report County Manager Abel Montoya reports that Conflict Management Training for County Employees was successful with 67 employees attending the two classes with additional training classes in December. Parks & Recreation Report Gilpin County Parks & Recreation went live with their new registration program, MaxGalaxy in October. The department can now offer online registration for programs and membership as well as upcoming events, activities and facilities reservations. Public Meetings --November 29 at 8 a.m., Wildfire Response Team Training, Community Center, 250 Norton Drive --December 6 at 9 a.m., Commissioners Special Meeting, Gilpin County Courthouse, 203 Eureka Street --December 18 at 9 a.m., Commissioners Regular Meeting, Gilpin County Courthouse, 203 Eureka Street Library Board Appointment Gilpin County Commissioners approved the appointment of Harv Mastalir to the Gilpin County Library Board. The appointment is for five years with the term expiring December 31, 2023. Executive Session Gilpin County Board of Commissioners recessed to Executive Session Pursuant to C .R.S. 24-6-402(4)(b) for the purpose of receiving legal advice on matters related to growth IGA and for the purpose of determining positions relative to matters that may be subject to negotiations, developing a strategy for negotiations, and/or instructing negotiators under C.R.S. 24-6-402(4)(e) Next Meeting The next Gilpin County Board of Commissioners meeting will be December 4, 2018, 9:00AM at the Gilpin County Courthouse at 203 Eureka St. Central City, Colorado.
