Gilpin to start enforcing county road parking violations

Prisoners to get new shower facilities By Randy Beaudette An ordinance on parking regulations, radon mitigation in the exhibit building, and a request to repair the jail showers were agenda items that the Gilpin County Board of County Commissioners (BoCC) tackled at their regular meeting on April 20, 2021. Board-Chair Linda Isenhart opened up the meeting at 9:00 am along with Commissioners Web Sill and Sandy Hollingsworth. Also joining online was County Manager Abel Montoya, County Attorney Brad Benning, Deputy Clerk Sharon Cate, and members from the Senior Leadership Team (SLT). COVID Update Gilpin County Emergency Manager Nathan Whittington informed the online participants that Gilpin County has had 212 total positive cases since March 2020, nine positive cases in the last seven days with a 5.9% positivity rate, and 26% of Gilpin residents are fully vaccinated. Approximately 200 folks are signed up to receive vaccinations this week, but there is a bit of a space conflict with Ameristar Casino and the vaccination site will be moved to the tenth floor. Public Trustee Report Gilpin County Treasurer Mary Lorenz presented the first quarter Public Trustee Report. There are no foreclosures reported in 2021, but there remains two left over from 2019 that need to be resolved. Releases remain strong as more residents are refinancing and paying off their mortgages. Acceptance of the report was 2-0 as Commissioner Hollingsworth was experiencing connectivity issues. Clerk and Recorder Report Gilpin County Deputy Clerk and Recorder Ashley Martin reported that the March 2021 numbers have finally moved into the positive after being in the negativity for first portion of 2021. Totals compared to 2020 are up by $111,000 for a total Funds Collected of $251,900. Motor Vehicle renewals are still collected via mail or by utilizing the Court House ballot box just outside the Clerk and Recorder’s office in Central City. Motor Vehicle appointments are booked out until June 2, so if a vehicle needs a license and an appointment is that far out, a Title and Bill of Sale can substitute as a temporary registration. Website Security Gilpin County Clerk and Recorder Sahari McCormick submitted a request to secure the Gilpin County website. On March 19 th the Secretary of State’s office notified the Clerk and Recorder that the Gilpin website was not secure. As a best practice all government websites should be secure. When constituents notice the “Not Secure” flag in the header, they assume that information is not legitimate for the site, and hence the County information cannot be trusted. Ms. McCormick is advocating that the Commissioners approve a request to acquire a security certificate. Cost of the certificate is $1,000 in which the Commissioners approved unanimously. Exhibit Building Radon Mitigation CSU Extension Agent Jennifer Cook submitted a request for radon mitigation in the barn lobby and office area. High radon was detected in 2007 in the two areas, but it is not clear why this issue was not addressed. A repeat test was accomplished recently and the results were confirmed. Unhealthy levels are above 4.0 pCi/L. The office test came in at 6.0 pCi/L and the lobby tested 6.9 pCi/L. A mitigation estimate from Colorado Radon Mitigation Inc. is $1,900. Money will come from the Fund Balance from the General fund. Gilpin County BoCC approved the request unanimously. Sheriff’s Report Gilpin County Sheriff Kevin Armstrong presented that Sheriff’s report for March 2021. Dispatch experienced an uptick in 911 calls in March. Victim Services increased to 135 victims served and 222 crimes. Domestic Violence increased with 12 occurrences to 60 in the County during the month of March. Identity theft and fraud also increased with most of the fraud cases associated with Unemployment claims. Categories added to the March Report are five cases of sexual assault, four cases of sexual assault on a child, and five child neglect cases. Detentions had 25 bookings for the month of March with the sharpest increase being domestic violence and gaming related arrests. Patrol saw a sharp increase in responses in the categories of trespasses, dog issues, DUI’s and REDDI reports which are directly related to the casinos opening and an increase in the number of visitors. Compliments include overdose intervention at a parking garage in Central City, traffic assist for Colorado State Patrol by an off-duty officer, a motorist assist that could have ended badly, and Sheriff Armstrong complimented several deputies that stayed at the Sheriff’s Office during the recent big snow storm. The Commissioners thanked all the folks at the Sheriff’s office for a job well done. Hazard Mitigation Plan Contractor Gilpin Emergency Manager Nathan Whittington informed everyone online that a contractor has been selected to revise the Hazard Mitigation Plan for a cost not to exceed $35,820. Wood Environmental Inc. has been awarded the contract to update the County’s current plan which will include the jurisdictions of Black Hawk, Central City, Gilpin County, and Timberline Fire. This item is covered by a recently awarded grant and in-kind donations. Gilpin County BoCC approved the contract award unanimously. Jail Shower Repair Facilities Maintenance Supervisor Dirk Mathews presented a request to repair the A-Pod showers at the jail. Because this was not in the 2021 budget. Mr. Mathews is required to seek approval from the Board for the repairs. The Commissioners agreed that this is a necessary repair after a scheduled tour of the jail by the Commissioners last week. Total cost of the repair will be around $15,890 for material and labor. The repairs for all four pods were in the 2020 budget, but due to COVID all capital improvements were cancelled. Because A-Pod is the one in the most need of repair, it will be repaired first. The Commissioners understands that this is an urgent need and approved a motion for the total amount with a 3% contingency clause. Substance Abuse Prevention Grant The Commissioners approved amendment #1 to the Substance Abuse Prevention Block Grant as presented by Youth Coordinator Jacob Rippy. Gilpin County was awarded a Substance Abuse Block Grant (SABG) through the Colorado Office of Behavioral Health to implement educational and recreational activities for our community’s youth and inform the whole community of various aspects of youth substance abuse. Programs funded by this grant will be Youth Camps, Botvin Lifeskills Classes, the EAGLE Teen Program, and information dissemination. Gilpin County receives approximately $150,000 per year provided through the monthly reimbursements. The majority of the funding is allocated to labor for implementing and coordinating the programs with the remainder used for equipment, supplies and training. Lifeguards Needed Parks and Recreation Director Gabrielle Chisholm submitted a request to approve midpoint pay for Lifeguard positions. The 2021 budget, two Lifeguard positions were budgeted at $14.10 per hour for 24 hours a week, and a head lifeguard was budgeted at $15.50 per hour for 24 hours a week. Due to a nationwide shortage of Lifeguards, Ms. Chisholm is requesting that Parks and Recreation hire Lifeguards at the mid-point salary range that has been budgeted rather than at the starting range of $11.75. The Commissioners approved a motion for the request to start Lifeguards at the mid-point range. Parking Ordinance (Ordinance 21-01) Gilpin County Attorney Brad Benning presented the second reading of Ordinance #21-01 which grants power to the Board to prohibit parking and impose fines for parking in violation of County ordinance. Vehicles parked on County roads or adjacent properties for an extended period is subject to being “Red Tagged.” If the vehicle is not removed after 24 hours, further action may follow. Exceptions to this ordinance are disabled vehicles due to mechanical malfunctions, weather related issues, and a temporary short-term special event such as a family get-together or community meeting. If after 24 hours the owner doesn’t contact the authorities, the vehicle may be considered abandoned and may be towed. Fines imposed by violations of this ordinance start at $25 for the first violation, $50 for the second, with subsequent violations reaching $100 per day. The Board unanimously approved Ordinance #21-01 effective upon the final publication of the revisions in the Weekly Register-Call . Legal Status Gilpin County Attorney Brad Benning presented an Inter-Governmental Agreement (IGA) with Black Hawk for improvement and maintenance of Lake Gulch Road. Presently Lake Gulch Road is considered to be a county road and is maintained by the County. With the recent approval of the Lake Gulch Whiskey Resort in the area, Black Hawk is requesting the deeding of Lake Gulch Road in which Black Hawk will be responsible for the improvements and maintenance of the road. Commissioner Sill made the motion to accept the IGA regarding the Lake Gulch Road, Commissioner Hollingsworth seconded, and the motion was approved unanimously. Shout Out Award Gilpin County Manager Abel Montoya presented a “Shout Out” award to Jane Billings as nominated by County Planner Tami Archer, in recognition and appreciation of her unwavering dedication to making sure everyone gets paid on time every time. Meeting Minutes Gilpin County Board of County Commissioners approved the Meeting Minutes from the April 6, 2021 Regular meeting, and the April 15, 2021 Special Meeting with no corrections or amendments. Executive Session Gilpin County Commissioners approved a motion to adjourn into Executive Session to confer with an attorney for the local public body for the purposes of receiving legal advice on specific legal questions per C.R.S. § 24-6- 402(4)(b).
