Commissioners Implement Stage 2 Fire Restrictions By Randy Beaudette Once again, The Gilpin County Board of County Commissioners (BoCC) meeting was called to order at the newly renovated historic Gilpin County Courthouse July 10, 2018 promptly at 9:03 am with Commissioners Ron Engels, Linda Isenhart, and Gail Watson. Also in attendance were County Attorney Jim Petrock and Deputy Clerk to the Board Sharon Cate. Agenda Review Gilpin County Commissioners added the Stage 2 Temporary Fire Restriction, the Dirk Larsen violations update, and a discussion concerning the recent Gymkhana incident at the outdoor arena to the agenda. Public and Press Comments A comment was heard from Jim Gantzler who requested an update on the Dirk Larsen violations in the Russel Gulch area. Mr. Gantzler stated that there are still a few trailers on the property, but his biggest concern was about fire. Mr Larsen has bulldozed over trees and there is slash on the property. There has been some progress, but Mr. Gantzler would like a progress report on what Gilpin County requested Mr. Larsen to do. Annual Liquor License Review Gilpin County BoCC Chair Ron Engels recessed the BoCC meeting to open the Local Licensing Authority (LLA) at 9:09 am. Gilpin County Deputy Clerk Sharon Cate presented two Liquor Licenses to be reviewed by the Local Liquor Licensing Authority (LLA). Pickle Liquors located at 661 Hwy 46, and Underground Liquors located at 15107 Hwy 119. Both had application reviews and were found to be satisfactory. The LLA reviewed approved both applications for the annual licenses. Commissioner Engels closed the LLA and resumed with the BoCC regular meeting at 9:11 am. Stage 2 Temporary Fire Restrictions Gilpin County Sherriff Bruce Hartman presented a Stage 2 Temporary Fire Restrictions (Resolution 18-08) which the Gilpin County Commissioners approved unanimously. Stage 2 is more restrictive than the Stage 1 restrictions Gilpin County is currently in. The Stage 2 Fire Restrictions are as follows: No building, maintaining, attending, or using a fire, campfire, coal or any type of charcoal fueled broiler or open fire of any type; No smoking, except within an enclosed vehicle or building; No shooting or discharging firearms for recreational purposes, except for hunting with a valid and current hunting license; No using explosive material: i.e. fireworks, blasting caps or any incendiary device which may result in the ignition of flammable material; No welding or operating an acetylene or other similar torch with open flame; No operating or using any internal combustion engine, i.e., chainsaw, without a USDA or SAE-approved spark arrester device properly installed, maintained and in effective working order. A chemical pressurized fire-extinguisher of not less than 8 ounces capacity by weight must be kept with the operator, and at least one round-point shovel with an overall length of at least 36 inches must be readily available for use; Exemptions: A wood burning stove may be used as long as it is in a structure. Any Federal, State or local officer or member of an organized rescue or firefighting force in the performance of an official duty; Mechanical stoves and appliances fueled by bottled or liquid gas which allow the operator to control and extinguish the flame with a shut off-valve, are permitted provided that such devices are approved by Underwriters Laboratory Inc. SUMMARY: There is NO OPEN BURNING of any kind allowed anywhere in Gilpin County. This includes campfires, bonfires, slash piles, charcoal grills, and agricultural burning regardless of location. ONLY liquid gas or propane fueled cooking stoves will be allowed for outdoor use. Software and Services Agreement Gilpin County Assessor Anne Schafer presented a Subscription License and Service Agreement between Gilpin County and Tyler Technologies of Yarmouth, Maine. Gilpin County has utilized Tyler/Eagle as a hardware and software supplier with tech support in the past. The previous contract expired in May 2018. Gilpin County would like to continue to retain the licensed software products and tech support services for the for the Gilpin County Assessor’s Office internal business purposes. The updated agreement will be for 5 years and will not include any hardware. Gilpin County utilizes Teryx for all their hardware needs. From January 1-June 30 th the monthly Tyler subscription fee was $4,095 which included hardware. The updated Tyler fee listed in this agreement is $2,668 without hardware. This represents a savings of $8,562 over a six month period, which can be allocated to update existing hardware through Teryx. The Board of Gilpin County Commissioners approved the updated Subscription License and Service Agreement as presented unanimously. Colorado Works and Child Care Program Gilpin County Human Services Director Sherrin Ashcroft presented a Memorandum of Understanding (MOU) between Colorado Department of Human Services (CDHS) and Gilpin County Board of Human Services. In the MOU, the County will administer and implement the Works Program and Child Care Program using fair and objective criteria in compliance with State and Federal law. In return, CDHS agrees to provide oversight of the Works Program and Child Care Program statewide. The State will develop standardized forms that will streamline the application process, the delivery of services, and tracking of participants. The State agrees to provide training and technical assistance to Gilpin County Human Services personnel and Child Care program staff. This updated MOU is the result of a negotiation process that was initiated a year and a half ago between County Commissioners and select County Directors and CDHS. Two main areas focus for this collaboration involved how any potential federal sanctions for failing to meet the Temporary Assistance for Needy Families (TANF) work participation rate (WPR) or the Child Care Assistance Program (CCAP) payment error rate is distributed among CDHS and County departments. Another area of focus included whether a county may be sanctioned if a county fails to meet a state rule that “conflicts with or exceeds” the requirements of federal regulation. Gilpin County Commissioners Approved the MOU unanimously. Facilities Use Policy Gilpin County Facilities Use Coordinator Vicki Nemec and Gilpin County Parks and Recreation Assistant Director Gabrielle Chisholm presented the latest revision of the proposed Facilities Use Policy. In this new revision, included is the request that “When possible all county or residents events should be scheduled two weeks in advance.” Other changes include an “Add swim party to the Multi-purpose Room (MPR) up to 20 swimmers for $40” resident and “$60” non-resident, a floor covering fee for any activities held in the Gym that have the possibility of damaging the floor, and the indoor rodeo/fair arena will now include the lobby area. Non-exclusive riding will be available from 6 am to 10 pm at no charge. The Gilpin County Commissioners approved the update Facilities use policy effective October 1, 2018. For a complete review of the updated policy go to: https://www.gilpinrecreation.com Public Hearing for Onsite Wastewater Treatment Chair Ron Engels opened up the Public Hearing at 9:53 am as a continuation of the June 28, 2018 Public Hearing concerning the On-Site Wastewater Treatment System (OWTS) Regulation Update. Community Development Director Stephen Strohminger presented a revised version of the Gilpin County Onsite Wastewater Treatment System Regulations for new construction. The updated revision includes the addition of the Local Requirements. They include Conceptual Approvals, More Stringent Separation Requirements, Vaults, and More Stringent maintenance Requirements for Higher Level Treatment Systems. These requirements are more stringent than the State requirements. With no further discussions, Gilpin County Commissioners approved the updated version of the OWTS. July is Parks and Recreation Month Parks and Recreation Assistant Director Gabrielle Chisholm presented a proclamation to designate July as Parks and Recreation Month. Parks and Recreation is an integral part of our community establishing and maintaining a quality of life in our community, ensuring the health of all citizens and contributing to the economic and environmental well-being of our community and region. The U.S. House of Representatives has designated July as Parks and Recreation Month and Gilpin County recognizes the benefits from parks and recreation resources. “Be it resolved by the Board of County Commissioners that July is recognized as Park and Recreation Month in the County of Gilpin.” Gilpin County Commissioners approved the Proclamation unanimously. Business Loan Fund Program Clear Creek Economic Development Council President and CEO Lindsey Valdez presented an application prepared for the Colorado Office of Economic Development and International Trade for the continued funding of the Region 3 Community Development Block Grant (CDBG) Business Loan Fund Program. This program serves both Clear Creek and Gilpin Counties by providing small business loans, loan guarantees, and Micro Enterprise program to small and medium sized businesses that do not qualify under the traditional lending institute guidelines. Since 1985, $7.4 million dollars have been loaned out the Region 3 businesses that has leveraged $17 million dollars in local investments. Ms. Valdez requested approval of the Region 3 Business Loan Fund application to be submitted to the Office of Economic Development and International Trade. The Commissioners motioned to approve the application with corrections, and a signature from the BoCC Chair is required to be eligible for continued funding. Legal Status Gilpin County Attorney Jim Petrock, Community Development Director Stephen Strohminger, and Gilpin County Sheriff Bruce Hartman provided an update on the clean-up and violation correction on the Dirk Larsen property. Sheriff Hartman stated that there have been some vehicles and a motor home that have been “Red Tagged;” however, because this location is not on a county road, it is not covered in the ordinances. This is on a public road not a county road. For this reason, the Sherriff’s department has not followed up on the tagged vehicles. The Gilpin County officials involved were hoping for volunteer cooperation, but that is obviously not happening. Mr. Petrock stated that there are numerous violations associated with this property and some of those violations are past the thirty-day grace period. The County filed a complaint with the County Court approximately two weeks ago and a court date is pending. To complicate matters further, Mr. Larsen resides in Nederland, thus his summons has to be processed by Boulder County. This has been an ongoing problem and the County hopes to resolve these issues soon. Employee Picnic Change The Gilpin County employee summer picnic has changed. The event will take place at the Community Center Multi-purpose Room on Thursday, August 2, from 11 am to 1 pm. Counter Proposal The Commissioners reviewed the latest proposal for the County Treasurer’s office customer service counter replacement from Mountain View Woodworking of Idaho Springs. Because this proposal is within the renovation budget, a formal vote was not required, but the Commissioners approved the proposal unanimously. Transit Coordinating Council Community Development Director Stephen Strohminger presented a draft resolution that would establish the Local Coordinating Council for transit. The council would consist of five members, including one Human Services Department member, and one Community Development Department member. The Council will have the responsibility of advising the BoCC on transit related opportunities, available transportation grants, transit promotion, organize and coordinate activities related to transportation opportunities, and other issues related to transit in Gilpin County. The Gilpin County Commissioners agreed to table the resolution until the 2019 budget period. Approval of Minutes Gilpin County Commissioners approved the meeting minutes from the June 26, 2018 regular meeting.
